Tesla, a renowned electric vehicle manufacturer led by Elon Musk, has initiated legal action against an Indian battery company for trademark infringement. The lawsuit, filed in the Delhi High Court, accuses the Indian firm, Tesla Power India Pvt Ltd, of using the “Tesla Power” brand to market its products, thereby violating on Tesla’s trademark. The U.S. automaker is seeking damages and a permanent injunction to prevent the Indian company from using Tesla name.

Court Proceedings Unfold

During a recent court hearing, Tesla presented its case, stating that the Indian company continued to use the “Tesla Power” name despite receiving a cease-and-desist notice in April 2022. The proceedings, detailed on the Delhi High Court’s website, reveal that Tesla Power India’s defence hinges on its focus on lead acid batteries and its claim of no intention to venture into the electric vehicle market. The court has granted the Indian company three weeks to submit a written response, along with supporting documents.

Trademark Controversy

The controversy centres around the use of the Tesla name, a brand closely associated with electric vehicles and renewable energy technology. Tesla’s complaint includes evidence such as screenshots from a website showing that Tesla Power USA LLC, also claimed to be headquartered in Delaware, is praised as a pioneer in affordable battery solutions with a significant presence in India. This overlaps confusingly with Musk’s Tesla, which is also incorporated in Delaware.

Company Responses

A representative from Tesla Power said that their company had been operational in India well before Elon Musk’s Tesla made its mark and that they had secured all necessary government approvals. “We have never claimed to be related to Elon Musk’s Tesla,” stated Manoj Pahwa, a spokesperson for Tesla Power.

The case is set to continue, with the next hearing scheduled for May 22.
