A lawyer has submitted a formal complaint to the District judge (Headquarters) urging an investigation and appropriate action against Sunita Kejriwal and other individuals for allegedly sharing recordings of virtual court proceedings. The complaint focuses on the purported dissemination of virtual hearing recordings involving Chief Minister Arvind Kejriwal’s appearance before the CBI Court in the Delhi Excise Policy case.
Allegations and Legal Action
Vaibhav Singh, the complainant, asserts that recordings of the hearing were circulated on social media platforms by Sunita Kejriwal and other political figures. Singh has also issued legal notices to social media platforms, demanding the removal of videos related to the court proceedings.
Request for Inquiry
The complaint seeks a thorough investigation into the matter and calls for appropriate action against all individuals and political entities involved. Singh contends that the dissemination of court recordings violates Video Conferencing Rules issued by the Court on October 26, 2021.
The complaint specifically targets Sunita Kejriwal, Akshay (using the handle @Akshay), Promila Gupta (Councillor, Ward 11, Timarpur), Vineeta Jain (Vice President of INC Rajasthan), and Dr. AruneshKumar Yadav (known as @YadavArunesh on social media). Allegations revolve around the unauthorized distribution of video and audio recordings of court proceedings held before Special Judge Kaveri Baweja on March 28.
Chronology of Events
On March 28, 2024, Chief Minister Arvind Kejriwal appeared before the Enforcement Directorate (ED) in the Delhi Excise Policy case. During the proceedings, Kejriwal presented his case directly to the special judge for CBI, sharing his narrative and facts.
Singh alleges that members of the Aam Aadmi Party and other opposition parties conspired to circulate the audio and video recordings of the court proceedings on social media platforms. The recordings, circulated with the hashtag #MoneyTrailExposedByKejriwal, are deemed by Singh as part of a broader conspiracy to discredit the judiciary and mislead the public.
The complaint posits that Kejriwal’s decision to present his case in court on March 28 was a calculated move to manipulate public sentiment. Singh contends that this act, coupled with the subsequent dissemination of court recordings, points to a premeditated scheme orchestrated by Kejriwal and his party members.
Social Media Dissemination
Following the conclusion of the hearing, numerous social media handles associated with the Aam Aadmi Party and other political parties purportedly shared the audio and video recordings of the court proceedings. Singh highlights the alleged reposting by Sunita Kejriwal, despite prohibitions under the High Court of Delhi Rules for Video Conferencing for Courts 2021.
Infringement Allegations
Promila Gupta, an Ex-Member of the Delhi Commission for Women and Ex-Member of the Governing Body of SPM College, is also implicated for her alleged involvement in sharing the court proceedings’ video/audio recordings.
